Client access to personal information

Policy

  • If asked:
    • You must inform the client about the existence, use and disclosure of their personal information.
    • You must give clients access to the personal information you hold about them. Valid exceptions may include the following:
      • Prohibitively costly to provide
      • Information contains references to other individuals
      • Cannot be disclosed for legal, security, or commercial proprietary reasons
      • Information subject to solicitor-client or litigation privilege.
    • You must account for how the information is and has been used.
    • You must inform them of third parties to whom the information has been disclosed.
      • You should be as specific as possible
  • You should respond to a request for access within a reasonable amount of time.
    • 30 days is a reasonable amount of time.
    • You must not charge clients for a response.
    • You must provide the information in a format that is generally understandable.
  • If you cannot provide the client with access to all the personal information you hold or have disclosed or when a challenge is not resolved to the satisfaction of the client you must contact the Distribution Privacy Officer.
